Soil in the biosphere and in modern Russian law. Communication 2. The concept of "soil" in Russian law and issues of environmental safety

In legal science and practice, one should have a full, scientifically substantiated and legal (legally significant) general legal, accurate, unambiguous, defined, well-established, non-contextual definition of soil and its fertility as a fundamental unique property. This will make it possible to adequately take into account soils as the most important resource, an indispensable component of ecosystems, protect them, objectively characterize fertility, and develop a fair taxation mechanism and state support for domestic agricultural producers. In the Decree of the President of the Russian Federation of April 19, 2017 No. 176 “On the Environmental Security Strategy of the Russian Federation for the Period until 2025”, the concepts of “land” and “soil” are separated in the document. It is noted that in almost all regions of the country there is a tendency to worsen their condition. Soils, their condition and fertility should be among the mandatory criteria and characteristics of environmental and food safety in the process of law enforcement and assessing the effectiveness of public administration.
